Criza justiţiei şi justiţia crizei  în drama  shakesperiană Neguţătorul din Veneţia

Abstract: ( The Crisis of Justice and the Justice of Crisis in Shakespeare's play The Merchant of Venice) In The Crisis of Justice and the Justice of Crisis în Shakespeare’s play The Merchant of Venice, the issue of the relationship between the harshness of the law and the necessity of moral conscience is addressed. Shakespeare’s play The Merchant of Venice illustrates the absolute moral anarchism of the Jew Shylock, opposed to the generosity of Antonio, who is always ready to sacrifice himself for the good and happiness of others. To help his friend Bassanio, Antonio accepts the sinister agreement with Shylock. This stipulates that, if he fails to repay his debt on time, he must pay with “a pound of human flesh” from his own body. Brought before the court due to bankruptcy and his failure to pay, Antonio knows that even the Duke himself cannot change the law; for if he were to alter it arbitrarily, he would endanger the order and stability of the state. From the height of his power, the Duke begs Shylock to show mercy to the unfortunate Antonio. Shylock, who desires Antonio’s death, remains unyielding, hiding his hatred and bloodthirsty intent under the shelter of the law. Apparently, we are witnessing a legal crisis impossible to resolve. Salvation comes from Portia, who disguises herself as a lawyer and pleads the case. The wise Portia finds the solution within the law itself, thus defending the law from dangerous deviations and interpretations of its own principles. All the while, Portia appeals to Shylock’s humanity, to mercy and human compassion. Seeing her efforts are in vain, Portia resolves the crisis through the power of the law: Shylock is permitted to cut a pound of flesh from the unfortunate Antonio, but not a single drop of blood may be shed. If even one drop of Christian blood is spilled, all his wealth, according to the law, will belong to Venice. Moreover, he must cut neither more nor less than exactly one pound of flesh, with utmost precision. But if he errs in the measurement, he is condemned to death and his property is forfeited to the state. A clear victim of his own monstrous wickedness, Shylock finds no solution to this impossible situation. Thus, he loses all his wealth, in full accordance with the laws of Venice, and barely escapes with his life thanks to the Duke’s clemency. The ending of the play brings to the forefront the restoration of the moral balance and order of the City.

Rezumat: Criza justiţiei şi justiţia crizei în drama shakesperiană Neguțătorul din Veneția , tratează problematica raportului dintre duritatea legii şi necesitatea  conştiinţei morale. Piesa shakesperiană Neguţătorul din Veneţia, ilustrează anarhismul moral absolut al evreului Shylock, în opoziţie cu generozitatea lui  Antonio, gata oricând să se sacrifice pentru binele şi fericirea celorlalţi. Pentru a-l ajuta pe prietenul său Bassanio, acceptă sinistra învoială cu Shylock. Aceasta prevede că, dacă   nu îşi  va plăti la timp datoria, să  plătească cu ,,un funt de carne omenească”  din propriul său trup. Ajuns la tribunal datorită falimentului şi a neplăţii datoriei, Antonio ştie că Dogele însuşi nu poate să schimbe legea; căci, dacă ar schimba-o, în mod arbitrar, ar pune în pericol ordinea şi stabilitatea statului. De la înălţimea puterii sale, Dogele îl roagă pe Shylock să aibă milă de nefericitul Antonio. Shylock, care voia moartea lui Antonio, se arată neclintit, ascunzându-şi ură şi sângeroasa-i pornire sub adăpostul legilor. Aparent, asistăm la o criză juridică, cu neputinţă de soluţionat. Salvarea vine de la Portia, care se deghizează în avocat şi susţine procesul. Înţeleapta Portia găseşte soluţia în interiorul legii, apărând astfel legea de deviaţiile şi interpretările periculoase ale legii însăşi. În tot acest timp, Portia caută să facă apel la umanitatea lui Shylock, la milă şi compasiunea omenească. Văzându-şi eforturile inutile, Portia rezolvă criza tot prin puterea legii: Shylock are voie să taie un funt din carnea  nefericitului Antonio, însă fără să curgă nici o picătură de sânge. Dacă curge o singură picătură de sânge creştinesc, atunci toată averea sa, conform legii, va reveni Veneţiei. În plus, nu are voie să taie nici mai mult, nici mai puţin, decât un funt de carne, cu maximă  precizie. Dar dacă va greşi la măsurat, atunci este condamnat la moarte şi averea rămâne statului. Victimă clară a răutăţii sale monstruoase, Shylock nu găseşte soluţie pentru rezolvarea acestei situaţii imposibile. Astfel încât, îşi pierde toată averea, tot conform legilor Veneţiei, şi abia scăpa cu viaţa datorită clemenței Dogelui. Finalul piesei aduce, în prim plan, restaurarea echilibrului  şi ordinii morale a Cetăţii.
